29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices. On or about June 6, 2016 and at times prior thereto, at the Tyson Foods facility in Hope, Arkansas, the employer did not ensure that equipment complies with recognized and generally accepted good engineering practice (RAGAGEP). Examples of such RAGAGEP include but are not limited to ANSI/ASHRAE Standard 15 (Safety Standard for Refrigeration Systems) and IIAR Bulletin No. 109 (IIAR Minimum Safety Criteria for a Safe Ammonia Refrigeration System). (a) The machinery room for the First Processing Refrigeration System did not have a self contained breathing apparatus (SCBA) located outside of but close to the exit door. (b) The machinery room for the Second Processing Refrigeration System did not have a self contained breathing apparatus (SCBA) located outside of but close to the exit door. c) failure of ventilation fan(s) in the First Processing mechanical room does not activate a monitored alarm. d) failure of ventilation fan(s) in the Second Processing mechanical room does not activate a monitored alarm. e) the machinery room for the First Processing refrigeration system is addressed as if it is an unclassified (not Class 1, Division 2 of the National Electric Code) by the employer because its ventilation system runs continuously, but is not equipped with an ammonia detector that alarms at 1000 ppm. f) the machinery room for the Second Processing refrigeration system is addressed as if it is an unclassified (not Class 1, Division 2 of the National Electric Code) by the employer because its ventilation system runs continuously, but is not equipped with an ammonia detector that alarms at 1000 ppm.
