Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: BEING CRUSHED OR STRUCK BY A BEAM BEING LIFTED BY A FORK LIFT AT ONE END AND A 6-TON COME ALONG ON THE OTHER END AND A SECOND COME ALONG INDUCING A DELIBERATE SIDE LOAD TO PULL THE BEAM INTO ALIGNMENT WITH THE CENTER LINE OF THE HOPPERS CAUSING IT TO SLIP OFF THE CRIBBING ON THE FORK LIFT END. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO PLACE THE BEAM DIRECTLY UNDER THE LOCATION WHERE IT IS TO BE LIFTED AND SET, USE SECURE END ATTACHMENT POINTS AND ELIMINATE ALL ECCENTRIC OR SIDE LOADS DURING THE LIFTING AND SETTING PHASE.
