Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees to that: a) Employees are exposed to being struck by falling metal parts and tank contents due to tank collapse at #2 Unit #6 tar tank. The roof was designed to be conical with the apex 1 foot 6 3/4 inches above the ring angle. It is now concave with water ponding to a depth of 1 foot + or -. Among other methods one feasible and acceptable abatement method to correct this hazard is to repair the tank (#2 Unit 36 Tar Tank) in accordance with sound engineering practices.
