Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees to that: a) On or about December 14, 1988, and at times prior thereto, employee cleaning sugar car interior was exposed to the hazard of a lack of emergency rescue capability in the event of an emergency such as fire, explosion or employee incapacitation. Feasible and acceptable abatement methods to correct this hazard include 1) Provide at least one standby man outside car for each employee inside the car. 2) Provide a mechanical retrieval system for employees inside sugar cars. 3) Provide a body harness or other suitable rescue devices which will maintain proper positioning and enable easy passageof a disabled body through the hatchway.
