29 CFR 1926.1053(b)(1): A portable ladder used for access to an upper landing surface did not have the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about September 11, 2020 and at times prior to and thereafter, at excavation sites located at the intersection of 91st and Aspen in Broken Arrow, OK, employees were allowed to use a ladder that did not extend at least 3 feet beyond the top of an excavation, exposing employees to the hazard of falls. Cherokee Pride Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1242458, citation number 1, item number 1, and as affirmed as a final order on November 28, 2017, with a final abatement date of November 3, 2017, with respect to a workplace hazard at 9854 S. 49th West Ave. Sapulpa, OK 74066.
