29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: On or about September 11, 2020, and at times prior to and thereafter, at excavation sites located at the intersection of 91st and Aspen in Broken Arrow, OK, the employer allowed employees to work in an excavation with an excavator parked adjacent to the edge , exposing the employees to struck-by hazards. Cherokee Pride, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1206000, citation number 1, item number 1b, and was affirmed as a final order on May 22, 2017, with a final abatement date of April 13, 2017, with respect to a workplace hazard at W. 81st Street and 23rd West Ave. Tulsa, OK 73132.
