1910.106(b)(2)(vii)(a): The area surrounding a tank or a group of tanks were not diked as provided in subdivision (c) of this subdivision, to prevent accidental discharge of liquid from endangering adjoining property or reaching waterways: The employer does not ensure an above ground storage tank containing diesel fuel is provided with diking to protect adjoining structures in the event of an accidental discharge. This violation was observed on or about July 13, 2016, behind the facility, in the employee parking area, exposing employees to fire and explosion hazards. Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure above ground storage tanks are diked.
