29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On or about September 15, 2020, and at times prior to and thereafter, at excavation sites located at the intersection of 91st and Aspen in Broken Arrow, OK, the employer allowed employees to work in an excavation with accumulated water, exposing employees to the struck-by hazards. Cherokee Pride Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(h)(1), which was contained in OSHA inspection number 1206000, citation number 1, item number 5a, and was affirmed as a final order on May 22, 2017, with a final abatement date of April 13, 2017, with respect to a workplace hazard at W. 81st Street and 23rd West Ave. Tulsa, OK 73132.
