29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested before employees entered excavations greater than 4 feet (1.22m) in depth: (a) 1511 Washington Street East: On or about January 10, 2017 and times prior, atmospheric testing was not conducted prior to permitting an employee to perform work in a 5 foot 4 inch deep trench with a continuously running Kohler 7hp gasoline engine and constant vehicle traffic located near the trench opening. Also in the trench with the employee was a polyethylene gas line near the opening of the trench where the excavator was sitting and a 6 inch steel line with unknown contents.
