Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer (did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees such as the spotters, tarpers and loaders not in the wheel loaders but working/walking in the transfer yard and inside the building located at 2415 Glendale-Milford Road were exposed to being struck by moving equipment such as wheel loader(s) and/or the skid-steer loader, in that: (a)On or about November 9, 2000, the bucket attached to the Caterpillar 938F, s.n. OIKM01027, wheel loader was 3' to 4' from the ground when exiting the bay door of the building creating blind spots for the operator. (b)On or about November 9, 2000, the Caterpiller 938F, s.n.. OIKM01027, wheel loader in use did not have a functional horn and was not removed from service until the horn was repaired. (c)On or about November 9, 2000, the manufacturer's operation & maintenance manual on safety, operation and maintenance for moving equipment such as the Caterpillar 938F, and 950G wheel loader, the Volvo wheel loader was not gone over with nor made available to loader operators using the loaders to move trash inside of the building and around the transfer yard at 2415 Glendale-Milford Road. (d)On or about November 9, 2000, an employee operating the skid-steer loader was not trained on the safety, operation and maintenance of the equipment used to move trash inside of the building and around the transfer yard at 2415 Glendale-Milford Road. (e)On November 13, 2000, the Caterpillar 950G wheel loader in use did not have a functional horn and the wheel loader was not removed from service until the horn was repaired; (f)On November 13, 2000, the engine for the Caterpillar 938F was not shut off while the operator was out of the cab. (g)Daily inspections were not being conducted on the Caterpillar 938F prior to use. Among feasible abatement methods training on the company's safety program (a) ensure that loader operators are instructed to ensure that the attachment should be no greater than 15" from ground to allow for good operators vision as required in the manufacturers operation and maintenance manual; (b/e) ensure that wheel loaders with non functional horns are removed from service until the horns are repaired as required in the manufacturers operation manual; provide training to all loader operators on the manufacturer's operation and maintenance manual prior to use as required by the warning labels in the cab and the manufacturer's operation and maintenance manual, allowing to operation of the loaders; (d) provide training to loaders operating the skid-steer loader prior to operation of the leader using equipment manufacturer institute (EMI) safety manual; (e) ensure that all loader operators are trained and understand that any loader not in operation should be parked and shut off before leaving the cab as required by the manufacturers operation and maintenancemanual; and (g) ensure that daily inspections are conducted prior to use of any wheel loader and/or steer loader and any unsafe conditions found are repaired prior to use.
