29 CFR 1910.303(b)(7)(iv): Electric equipment has damaged parts that may adversely affect safe operation or mechanical strength of the equipment, such as parts that are broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating: A recent example of the employer's violative conduct occurred on this occasion: a) 9000 River Rd, Delair, NJ, 08110- Building 8, Sutton 4 Press: Employees operated equipment including, but not limited to, a P&H Hevi-Lift underhung, rail mounted hoist (shapes internal machine number 1562) to move extrusion items including, but not limited to, billets where the control box was damaged, observed on or about 3/9/2017. To abate this violation, the employer must ensure that there are no damaged parts that may adversely affect safe operation or mechanical strength of the equipment. Abatement can also include removing each damaged control box from service to prevent use. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING A DESCRIPTION OF THE STEPS IT IS TAKING TO ENSURE COMPLIANCE WITH THIS STANDARD TO PROTECT EMPLOYEES FROM ELECTRICAL HAZARDS, INCLUDING TRAINING ON HOW TO INSPECT AND IDENTIFY ELECTRICAL EQUIPMENT WITH DAMAGED PARTS. THE DOCUMENTATION SHOULD SPECIFICALLY INCLUDE A COPY OF THE DAILY INSPECTION RECORDS AND PHOTOGRAPHS AND DESCRIPTION OF THE REPAIRED ELECTRICAL EQUIPMENT. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1910.303(b)(7)(iv), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
