29 CFR 1910.303(b)(2): Listed or labeled electrical equipment is not used or installed in accordance with instructions included in the listing or labeling: A recent example of the employer's violative conduct occurred on this occasion: a) 9000 River Rd, Delair, NJ, 08110- Die Correction: Employees performed work including, but not limited to, bench work on dies and were exposed to a two inch by four inch (two gang) 120 volt electrical junction box that was not used as listed or labeled and instead was used as a pendant, observed on or about 1/24/2017. To abate this violation, the employer must ensure the electrical equipment is installed according to the manufacturer's instructions or the listing and labeling instructions. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING A DESCRIPTION AND PHOTOS OF THE STEPS TAKEN TO PROTECT EMPLOYEES FROM ELECTRICAL HAZARDS. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.303(b)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 28b, AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016 WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
