29 CFR 1910.219(e)(1)(i): Horizontal belts which have both runs 42 inches or less from the floor level are not fully enclosed by guards conforming to requirements specified in 29 CFR 1910.219(m) and (o): A recent example of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Building 3, Sutton 1 Press: The belts and drive mechanisms on the Sutton 1 Press, where employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations, were not guarded, occurred on or about 2/9/2017. b) 9000 River Rd, Delair, NJ, 08110- Building 6, Sutton 3 Press: The belts and drive mechanisms on the Sutton 3 Press, where employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations, were not guarded, occurred on or about 2/9/2017. c) 9000 River Rd, Delair, NJ, 08110- Building 8, Sutton 4 Press: The belts and drive mechanisms on the Sutton 4 Press, where employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations, were not guarded, occurred on or about 2/24/2017. d) 9000 River Rd, Delair, NJ, 08110- Building 9, BLH Press: The belts and drive mechanisms on the BLH Press, where employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations, were not guarded, occurred on or about 2/9/2017. e) 9000 River Rd, Delair, NJ, 08110- Building 10, Danieli Press: The belts and drive mechanisms on the Danieli Press, where employees performed work including, but not limited to, cold saw and packing operations in the vicinity of the Danieli press cold saw and rack lift area, were not guarded, occurred on or about 2/24/2017. To abate this violation, the employer must properly guard the belts on all of the drive mechanisms on all of the press lines, including, Sutton 1, 3, and 4, BLH and Danieli. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING A DESCRIPTION OF THE GUARD INSTALLED AND THE LOCATION OF THE GUARD. THE EMPLOYER IS ALSO REQUIRED TO PROVIDE PHOTOS OF THE GUARDS COVERING THE DRIVE MECHANISMS. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.219(e)(1)(i),WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 22b AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016 WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
