29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform are not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o): Recent example of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Building 3, Sutton 1 Press: Employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations on equipment including, but not limited to, the Sutton 1 press where pulleys were not completely guarded on the drive mechanisms, occurred on or about 2/9/2017. b) 9000 River Rd, Delair, NJ, 08110- Building 6, Sutton 3 Press: Employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations on equipment including, but not limited to, the Sutton 3 press where pulleys were not completely guarded on the drive mechanisms, occurred on or about 2/9/2017. c) 9000 River Rd, Delair, NJ, 08110- Building 8, Sutton 4 Press: Employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations on equipment including, but not limited to, the Sutton 4 press where pulleys were not completely guarded on the drive mechanisms, occurred on or about 2/24/2017. d) 9000 River Rd, Delair, NJ, 08110- Building 9, BLH Press: Employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations on equipment including, but not limited to, the BLH press where pulleys were not completely guarded on the drive mechanisms, occurred on or about 2/9/2017. e) 9000 River Rd, Delair, NJ, 08110- Building 10, Danieli Press: Employees performed work including, but not limited to, metal stretching, table manipulation, and cold saw operations on equipment including, but not limited to, the Danieli press where pulleys were not completely guarded on the drive mechanisms, occurred on or about 2/24/2017. To abate this violation, the employer must properly guard the drive mechanisms on the pulleys on all of the press lines, including, Sutton 1, 3, and 4, BLH and Danieli. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING A DESCRIPTION OF THE GUARD INSTALLED AND THE LOCATION OF THE GUARD. THE EMPLOYER IS ALSO REQUIRED TO PROVIDE PHOTOS OF THE GUARDS COVERING THE DRIVE MECHANISMS. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.219(D)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 22A AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER RD DELAIR, NEW JERSEY 08110.
