29 CFR 1910.212(a)(1): One or more methods of machine guarding is not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: Recent examples of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Building 1, Fabrication: Employees operated the Oliver metal cutting saw (Shapes internal machine number 117) to cut aluminum parts where a guard was not installed to prevent flying chips and the chip collector system did not provide adequate protection, on or about 1/23/2017. b) 9000 River Rd, Delair, NJ, 08110- Building 1, Fabrication: Employees operated the B&O clam shell type saw (Shapes internal machine number 2048) to cut aluminum parts where a guard was not installed to prevent flying chips and the chip collector system did not provide adequate protection, observed on or about 2/24/2017. c) 9000 River Rd, Delair, NJ, 08110- Building 1, Fabrication: Employees operated and manually lubricated the Oliver metal cutting saw (Shapes internal machine number 937) where guarding against flying chips, sparks, and unused portions of the blade was not provided due to the coolant lines being inoperable, observed on or about 2/24/2017. d) 9000 River Rd, Delair, NJ, 08110- Building 11, Maintenance Area: Employees operated the Jet horizontal metal cutting band saw, Model E310262, Serial Number WJ5242 to perform saw operations for the purposes of table maintenance where the unused portion of the blade was not guarded, observed on or about 2/24/2017. e) 9000 River Rd, Delair, NJ, 08110- Building 11, Fabrication: Employees operated the Wilton horizontal metal cutting band saw Model 3410, Serial Number 050710296 to cut materials such as, but not limited to, metal and plastic with approximately four inches of the unused portion of the blade exposed, which occurred on or about 1/23/2017. f) 9000 River Rd, Delair, NJ, 08110- Building 1, Fabrication: Employees operated the Cincinnati drill press (Shapes internal machine number 6020-4) to drill holes where the rotating chuck was insufficiently guarded and was bypassed to manually apply lubricant to the stock/bit during operation, observed on or about 2/24/2017. g) 9000 River Rd, Delair, NJ, 08110- Building 1, Fabrication: Employees operated a G & P Machinery Corp, one inch belt sander, Model IS00 (Serial Number undeterminable) to deburr items without a guard to protect employees from ingoing nip points, flying chips or particles both above and below the table, observed on or about 1/23/2017. To abate this violation, the employer must ensure employees are protected from hazards created by in-going nip points, unguarded chucks and rotating parts such as drill bits, unguarded saw blades, and flying chips and particles. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING PHOTOS AND STEPS IT IS TAKING TO ENSURE THAT GUARDS ARE IN PLACE DURING USE AND ARE NOT REMOVED. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.212(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 17, AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016 WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
