29 CFR 1910.134(c)(2)(i): Respirator users are not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determines that any voluntary respirator use is permissible: Recent examples of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Fabrication: Appendix D was not provided to employees who were given N95 respirators to use while working in the fabrication department, on or about 2/15/2017. b) 9000 River Rd, Delair, NJ, 08110- Maintenance: Appendix D was not provided to employees who were given N95 respirator to use while working throughout the facility, on or about 2/15/2017. c) 9000 River Rd, Delair, NJ, 08110- Foundry: Appendix D was not provided to employees who were given N95 respirators to use while in the foundry, occurred on or about 1/24/2017. d) 9000 River Rd, Delair, NJ, 08110- Anodizing: Appendix D was not provided to employees who were given N95 respirators to use while in the anodizing area, occurred on or about 1/24/2017. To abate this violation, the employer must establish a system to ensure that Appendix D, including the manufacturer's information for the respirator, is provided to employees prior to using the respirator. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING THE STEPS IT IS TAKING TO ENSURE THAT ITS EMPLOYEES ARE PROVIDED WITH APPENDIX D AND FOLLOW THE REQUIREMENTS SET FORTH IN APPENDIX D. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.134(c)(2)(i), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 4, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
