29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. Located at 1799 Woodland Drive, Delaware, Ohio: On or about December 15, 2021, and at times prior, a portable ladder was used on the left side of the roof to access the upper landing surface of the roof, without extending at least three feet above or requiring grasping devices. As a result, employees were exposed to falls of approximately twelve feet. b. As a result, employees were exposed to falls of approximately twelve feet. A & H Roofing Services, LLC was previously cited for a Repeat-Serious violation of this Occupational Safety and Health Standard, 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1520996, citation number 1, item number 5, and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 467 Landings Loop, Westerville, Ohio 43082. A & H Roofing Services, LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard, 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1479491, citation number 1, item number 4, and was affirmed as a final order on July 27, 2020, with respect to a workplace located at 2315 Canterbury Rd, Upper Arlington, Ohio 43221. A & H Roofing Services, LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard, 29 CFR 1926.1053(b)(1), while performing work under the owner's name, Abel Hernandez, which was contained in OSHA inspection number 1458624, citation number 1, item number 5 and was affirmed as a final order on March 31, 2020, with respect to a workplace located at 6575 Greenway Loop, Dublin, OH 43016.
