29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) On June 27, 2017, the employer did not provide information and training to employees exposed to hazardous chemicals including the following: Energy Elite Developer (contains Disodium Metasilicate 5-10%, Sodium Gluconate 1-5%, Sodium Octanoate 1-5%, and has a pH of 13.3); THR200 Plate Developer (contains Disodium Metasilicate 3-5%, Sodium Octanoate 1-5%, Sodium Hydroxide 0.1-0.5%, and has a pH of 13); UNIFIN (contains Benzenesulphonic Acid, dodecyl (sulphophenoxy)-disodium salt 1-5%, Citric Acid - 1-5%, Sodium Hexametaphosphate 1-5%, Potassium Citrate 1-5%, and has a pH of 3.6). (b) On June 27, 2017, the employer did not provide training to employees by December 1, 2013, on the revised safety data sheet (SDS) format and content, as well as the new labeling system elements, as required by the revised hazard communication standard, 29 CFR 1910.1200. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
