29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladders were not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladders. (a) 1021 Mount De Chantel Rd, Wheeling, WV - On or about May 12, 2021, employees were accessing the roof using a fiberglass reinforced plastic (FRP) extension ladder which did not extend at least 3 feet above the upper landing surface, exposing employees to fall of up to 11 feet. (b) 1021 Mount De Chantel Rd, Wheeling, WV - On or about May 12, 2021, employees were accessing the roof using an aluminum extension ladder which did not extend at least 3 feet above the upper landing surface, exposing employees to fall of up to 11 feet. Charm Builders was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1253476, citation number 1, item number 4 and was affirmed as a final order on 9/4/2018, with respect to a workplace located at 47 2nd Street NE Massillon, OH 44646.
