29 CFR 1910.28(b)(11)(ii):The employer does not ensure each flight of stairs having at least 3 treads and at least 4 risers are equipped with stair rail systems and handrails per Table D-2; Recent examples of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Building 11: The stairway, containing 6 treads and used to access the bay area, was not equipped with an adequate stair rail system. The stair rail was missing a mid-rail, on or about 1/24/2017. b) 9000 River Rd, Delair, NJ, 08110- Building 8 , Sutton 4: The stairway, containing 5 treads and used to access the cooling table to retrieve metal, was not equipped with an adequate stair rail system. The stair rail was missing on one side and a mid-rail was missing on the other side, 2/23/2017. c) 9000 River Rd, Delair, NJ, 08110- Building 7: The stairway, containing 19 treads and used to access the upstairs auditorium/conference room, was not equipped with an adequate stair rail system. The stair rail was missing a mid-rail, on or about 3/15/2017. To abate this violation, the employer must ensure that each set of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems (top, intermediate rail and where there is a hazard for falling objects a toeboard) and handrails. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING THE STEPS IT IS TAKING TO ENSURE COMPLIANCE WITH THE STANDARD TO PROTECT EMPLOYEES FROM FALL HAZARDS ASSOCIATED WITH THE LACK OF RAILINGS; INCLUDING THE STEPS TAKEN TO ENSURE COMPLIANCE WITH THIS STANDARD, AND PHOTOGRAPHS OF THE STAIRS WITH THE INSTALLED STAIR RAIL SYSTEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.24(h) (OLD STANDARD), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 5, AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/16, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER RD, DELAIR, NJ, 08110.
