Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees, in that, the hooks the employer uses to remove hubs are not equipped with functioning safety latches, exposing employees to potential struck hazards from falling hubs. a.Republic Engineered Products, Inc. located in Lorain, Ohio: The employer fails to ensure that cranes and hoists are equipped with functioning safety latches. This practice exposes workers to crushing and struck-by hazards from falling loads while working adjacent to Cold Saw #1, located in the Conditioning Building. b.Republic Engineered Products, Inc. located in Lorain, Ohio: The employer fails to ensure that cranes and hoists are equipped with functioning safety latches. This practice exposes workers to crushing and struck-by hazards from falling loads while working adjacent to Cold Saw #2, located in the Conditioning Building. Among other methods, a feasible and acceptable method to correct this hazard is to ensure hooks are equipped with safety latches in accordance with ASME B30.10-2005 "Hooks", Section 10- 1.2.3. Republic Engineered Products Inc. was previously cited for a same or similiar violation of the general duty clause of the Occupational Safety and Health Act, for crane and hoist hooks not being equipped with functioning safety latches, which was contained in OSHA inspection #309445112, Citation #1, Item #1 and was affirmed as a final order on June 12, 2008, with respect to a workplace located at 1807 E. 28th St., Lorain, Ohio. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
