29 CFR 1910.22(d)(1): The employer did not always ensure the loads approved by the building official is marked on plates of approved design supplied and securely affixed by the owner in a conspicuous place in every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not ensure the load bearing capacity is marked. This violation was observed on or about April 15, 2009 in the following instance: The employer had not ascertained the load bearing capacity of the office area located in the PMA Warehouse exposing employees to struck-by and fall hazards as well as explosion / fire hazards. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all areas requiring load bearing plates have been approved and plates affixed in a prominent location.
