Text For Citation: 03 Item/Group: 002 Hazard: EXPLOSION
North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)throughout the facility - frequent fires in the facility are not reported to the Charlotte Fire Department. Reference NFPA 1-13, Charlotte Fire Department: Whenever an unwanted fire occurs in any building or premises of any kind, the owner, manager, occupant, or any person in control of such building or premises, upon discovery of an unwanted fire, or evidence of there having been an unwanted fire, even though is has apparently been extinguished, shall immediately cause notice of the existence of such fire, circumstances of the same, and the location thereof to be given to the fire department. Among other methods, one feasible and acceptable abatement method is: To implement and enforce a policy to report all fires to the Fire Department.
