29 CFR 1910.134(c)(2)(i): 29 CFR 1910.134(c)(2)(i): When the employer determined that any voluntary respirator use was permissible, the employer did not provide the respirator users with the information in Appendix D of this section ("Information for Employees Using Respirator When Not Required Under the Standard"): In the service department at 865 Quaker Hwy. Uxbridge MA 01569: On or about May 17, 2024, at times prior, and at times after, the information in 29 CFR 1910.134 Appendix D was not provided to employees who use 3M tight-fitting elastomeric respirators with cartridges and N95 filter face piece disposable respirators on a voluntarily basis. Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. The Acting Secretary of Labor has filed a petition for subpoena enforcement in the U.S. District Court of Massachusetts, as part of which the Asking Secretary has asked that the statute of limitations for OSHA to issue citations be tolled.
