29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On August 5, 2022, and at times prior, at or near 520 16th Street NE in Mandan, North Dakota, employees working in a trench 16 or more feet deep were exposed to falling object hazards where a piece of lumbar that was unsecured sitting on the top edge of the trench box above the employees. The Weisz and Sons, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 1523749, citation number 1, item number 1c and was affirmed as a final order on September 8, 2021, with respect to a workplace located at in the vicinity of 500 Old Red Trail in Mandan, North Dakota..
