29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about March 10, 2022, an employee accessing a balcony to remove roofing materials with a ladder which did not extend at least three feet above the balcony. The Cesar Avila company dba RBD Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1359892, citation number 1, item number 1 and was affirmed as a final order on February 28, 2019, with respect to a workplace located at 4537 24th Ave., Kenosha, WI 53140.
