29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about June 28, 2019, at the road construction site located on (State Hwy 11) Durand Ave. near the Ohio St. intersection, Racine, WI, employees were exposed to cave-in hazards while conducting pipe repair work in an unprotected trench. The competent person determined that the trench required cave-in protection, but failed to have the trench protection installed where employees were exposed to cave-in hazards nor had a sufficient number of egress points installed in the trench for employees to exit the trench safely.
