29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). The employer does not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specific in this paragraph(l). This violation was most recently observed on or about October 18, 2017 when: A Hyster Lift Truck Model S60XM (Serial No. D187V14672W) and a Hyster Lift Truck Model 5100B (Serial No. C004D09613H) were operated by employees to transport paperboard material and the operators had not received equipment specific formal instruction, practical training, or an evaluation as to their ability to safely operate the equipment, as well as on two prior occasions, as described below. To abate this violation, the employer must ensure that each employee who operates powered industrial trucks is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l). Midvale Paper Box Company, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 954509, citation number 1 item number 1b and was affirmed as a final order on 2/20/2014, with respect to a workplace located at 19 Bailey St, Plains, PA Midvale Paper Box Company, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1066769 citation number 3 item number 3 and was affirmed as a final order on 6/17/2017, with respect to a workplace located at 19 Bailey Street, Plains Township, PA.
