29 CFR 1910.28(b)(1)(i): The employer does not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: Recent examples of the employer's violative conduct occurred on these occasions: a) 9000 River Rd, Delair, NJ, 08110- Anodizing bridge: The employer did not ensure that a complete guardrail system that included a top rail was installed next to tanks to prevent employees from falling 64 inches to the ground below, observed on 2/24/2017. b) 9000 River Rd, Delair, NJ, 08110- Foundry: The employer did not ensure that employees were protected from falling into the furnace pits 12 feet below the ground level when working in the vicinity of the furnaces 1- 4, on or about 2/10/2017. c) 9000 River Rd, Delair, NJ, 08110- Foundry: The employer did not ensure that employees were protected from falling to the ground below while connecting the hooks of an overhead crane to the corners of a casting table mold. The working height was in excess of six feet from the ground below, on or about 3/15/2017. To abate these violations, the employer must ensure that employees on a walking working surface with an unprotected side that is 4 feet (1.2 m) or more above a lower level are protected from falling by using one or more of the following: guardrail systems, safety net systems, or personal fall arrest systems. For instance, the employer can abate the violations by (a) installing a complete guardrail system on the Anodizing bridge, (b) installing a fall protection system around the furnace pits and (c) developing and implementing a system to connect the casting table molds to the crane without exposing employees to fall hazards. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, AND PURSUANT TO 29 CFR 1903.19, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, INCLUDING A DESCRIPTION AND PHOTOS OF THE STEPS IT IS TAKING TO PROTECT EMPLOYEES FROM FALL HAZARDS. THE DOCUMENTATION SHOULD SPECIFICALLY INCLUDE: (A) PHOTOS OF THE COMPLETED GUARDRAIL SYSTEM; (B) PHOTOS OF THE FALL PROTECTION SYSTEM INSTALLED FOR THE FURNACE PITS (IF PERSONAL FALL ARREST OR SAFETY NETS ARE USED, THE POLICY FOR THESE ITEMS, ALONG WITH THE PROCEDURES USED TO ENSURE THEIR IMPLEMENTATION SHOULD BE SUBMITTED.); (C) PHOTOS OF THE FALL PROTECTION SYSTEM WHEN INSTALLED, OR WHEN A FALL PROTECTION SYSTEM IS NOT ABLE TO BE INSTALLED THEN ALTERNATIVE PROCEDURES MUST BE DEVELOPED TO ATTACH THE MOLD TO THE OVERHEAD CRANE WITHOUT EXPOSING EMPLOYEES TO FALL HAZARDS. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. ALUMINUM SHAPES LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1910.23(c)(1) (PREVIOUS STANDARD), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1059368, CITATION NUMBER 1, ITEM NUMBER 3 AND WAS AFFIRMED AS A FINAL ORDER ON 7/5/2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9000 RIVER ROAD, DELAIR, NEW JERSEY, 08110.
