29 CFR 1910.1053(d)(3)(iii): Where the most recent exposure monitoring indicated that employee exposures were at or above the action level (AL) but at or below the permissible exposure limit (PEL), the employer did not repeat such monitoring within six months of the most recent monitoring: Foundry Area: On or about February 22, 2024, and at times thereafter, where the most recent exposure monitoring indicated that employee exposures were at or above the AL but at or below the PEL, the employer did not repeat such monitoring within six months of the most recent monitoring that last occurred on October 12, 2022, when employees were exposed at or above the AL. After employees were exposed above the AL, the employer did not ensure that exposures were reduced by installing the appropriate engineering controls and establishing work practice controls that would limit exposures for employees who were overexposed at 64 micrograms of respirable crystalline silica per cubic meter of air (?g/m�) as an 8-hour time-weighted average (8-hr TWA).
