29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: (a) On or about June 18, 2021, for the employees working in a trench eight feet in depth with vertical walls beneath an undercut concrete sidewalk, where there existed loose material on the spoil pile in the vicinity of Old Red Trail & Eighth Avenue NW in Mandan North Dakota. Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(j)(2) which was contained in OSHA inspection number 1439850, citation number 2, item number 1a and was affirmed as a final order on December 14, 2019, with respect to a workplace located in the vicinity of 313 Fox Hills Parkway in Watford City, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.651(j)(2) which was contained in OSHA Inspection Number 1416918, Citation 1, Item 1b and was affirmed as a final order on August 27, 2019 with respect to a workplace located in the vicinity of Shafer Street & College Drive in Bismarck, North Dakota.
