North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)site, yard/shop - on or about 06/19/06 an employee was observed operating a powered industrial truck, Clark, model #C500-S100, serial #685-0326-9150 KO1, 5,750 lbs capacity, when the installed and attached seat belt was not fastened and in use. b)site, yard/shop - on or about 07/26/06 an employee was observed operating a powered industrial truck, Clark, model #C500-S100, serial #685-0326-9150 KO1, 5,750 lbs capacity, when the installed and attached seat belt was not fastened and in use. Among others, one feasible and acceptable abatement method, among others, to correct this hazard is to develop, establish and/or update written procedures on proper equipment usage, train and/or retrain employees on applicable and acceptable established procedures, prohibit employees from performing and/or attempting to perform inappropriate and unsafe procedures, and enforce established and/or applicable policies and procedures for equipment usage.
