29 CFR 1910.119(n): The employer did not include a procedure in its emergency response plan that instructs employees on how to distinguish between small releases and spills and large releases and spills and what employee actions are required in both instances: (a)Suncor Energy (U.S.A.), Inc., 5801 Brighton Blvd., Commerce City, Colorado: On or about September 8, 2008, and at times prior thereto, the employer's emergency response plan did not include a procedure on how to distinguish between small releases and spills and large releases and spills, and the employer did not instruct employees on how to distinguish between small releases and spills and large releases and spills. This increases the likelihood that employees will respond to releases beyond their abilities and level of training and increases potential exposure to fire and explosion hazards.
