North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Caught by hazards with moving conveyor shackles.[Ref. (ASME B20.1-2000) Safety Standard for Conveyors and Related Equipment Chapter 5.11.2(c)(1) All emergency stop devices were easily identifiable in the immediate vicinity of such locations unless guarded by location, or guards.] a) rework station and inspection line - the single hook conveyor used to deliver USDA rejected birds to the salvage station was only provided with one stop and start control button, leaving employees who may get their finger hung into the unguarded moving conveyor shackles without access to an emergency stop. Abatement note: One means of abatement would be the addition of an emergency stop line / button installed within reach of all employee stations on the line, to include employees in the "Re-work" area and the USDA inspector assistants. In the Alternative: 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by points of operation, ingoing nip points, rotating parts and flying chips and sparks: a) rework station and inspection line - the single hook conveyor used to deliver USDA rejected birds to the salvage station was only provided with one stop and start control button, leaving employees who may get their finger hung into the unguarded moving conveyor shackles without access to an emergency stop.
