Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from mixers not being dust tight. (a) Accel Color Corporation (Accel Corporation), Avon, Ohio: On or about February 28, 2008, Mixer 2 manufactured by Prodex (Model 500; Serial 830802) was not maintained to ensure a dust tight seal between the mixer housing and the lid. During mixing operations with combustible dust, dust would leak out between the mixer housing and the lid into the air around the mixer posing a combustible dust hazard. Abatement Note: Among other methods, a feasible abatement method to correct this hazard is to repair the seal on Mixer 2 to ensure dust does not escape when mixing. Reference the National Fire Protection Association (NFPA) 654 Standard for the Prevention of Fire and Dust Explosions from Manufacturing, Processing, and Handling of Combustible Particulate Solids. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
