Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were exposed to being struck by the boom of a crane with a possible defective boom lifting mechanism. a. On or about 11/8/04, on the jobsite, two employees were injured when struck by a 150 foot long crane boom on a Lima Crawler Crane that has a possible defective boom lifting mechanism. Among other methods, one feasible and acceptable abatement method to correct the hazard as recognized by the employer is to adopt procedures that would prohibit employees from working under or around the crane boom while inspection or maintenance activities are taking place.
