Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries caused by the operation of defective manure trucks and components: In the following instances defective manure trucks were operated: a)Truck 498 - A mounting strap on the driver side fuel tank was broken. A mounting strap on the passenger side fuel tank was broken. The seat was not equipped with a seatbelt. b)Truck 320 - The seat was not equipped with a seatbelt. The horn was not operational. The passenger side headlight was broken. c)Truck 489 - The seat was not equipped with a seatbelt. A mounting strap on the driver side fuel tank was bent. The driver side floorboard contained a hole. d)Truck 321 - A mounting strap on the driver side fuel tank was broken. A mounting strap on the passenger side fuel tank was broken. The horn was not operational. Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace and repair defective parts and equipment. Your company was previously cited for a violation of this Occupational Safety and Health Standard which was contained in OSHA Inspection Number 300304987, Citation Number 1, Item Number 1, issued on 11/30/00.
