North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (Reference ANSI B56.1 Safety Standard for Power Industrial Trucks, Manufacturers Operating Manuals: a)throughout the facility - fork lift operators do not wear safety belts while operating trucks and employer has removed and/or tied back the seat belts on the vehicles to prevent their use. Among other methods, one feasible and acceptable abatement method to correct this hazard is to reinstall and/or untie seat belts. Train operators to understand the warnings and operating procedures in the vehicle's Operating Manual. Implement the use of seat belts while operating the vehicles.
