Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about May 28, 1985, employees were allowed to ride on a FMC Power Speed Sprayer Model G-957 that was being used in No. 1 Rock Field of the Big Cypress Reservation and was not provided with an adequate seat or platform, exposing employees to falls from moving power sprayer and being run over by the wheels. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit any employee from standing or sitting on the power speed sprayer while it is in motion, according to the warning in the manufacturer's instructional manual.
