29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about March 27, 2025, and times prior to, Sun Auto Tire & Service Inc. mounted working platforms onto Hyster R30XMS3/S2 Class II powered industrial trucks for the purpose of moving materials around the warehouse. The employer made modifications or changes which affected capacity and operation without the prior written approval of Hyster at a worksite located at 2075 Corporate Circle in Cape Girardeau, Missouri.
