29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and which identifies the document as a certification of hazard assessment: In the service and detail department at 865 Quaker Hwy. Uxbridge MA 01569: On or about May 17, 2024, at times prior, and at times after, employees working in the detailing and service departments wore personal protective equipment to include N-95 filtering facepiece device respirators, gloves, safety shoes and safety glasses for detailing and maintenance of recreational vehicles and no written certification of a hazard assessment had been completed. Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. The Acting Secretary of Labor has filed a petition for subpoena enforcement in the U.S. District Court of Massachusetts, as part of which the Asking Secretary has asked that the statute of limitations for OSHA to issue citations be tolled.
