29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. The employer failed to report an amputation within the required time frame. This was most recently documented on or about October 30th, 2023, at 4501 South 36th Street, Omaha, Nebraska 68107 On October 20, 2024, the employer had an employee operating bandsaw #3 and was struck in the back by a rack of ribs forcing his hand into the point of operation of the bandsaw resulting in the amputation of a portion of his index finger. The employer failed to report this amputation until October 23, 2024 exceeding the 24 hour requirement under this subpart.
