29 CFR 1926.59: The employer did not develop a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference: 29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met. The employer is failing to protect employees from chemical hazards. The condition was most recently observed on or about October 27, 2023, when 4 employees were observed working at 569 Crystal Stream Drive in Wentzville, Missouri. Gasoline was present at the worksite and used by employees to power air compressors for pneumatic nail guns. A safety data sheet for gasoline was not present on site, nor did the employer have a written hazard communication program, thus exposing employees to chemical hazards.
