29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Facility: On or about 7/20/2023, the employer did not provide medical evaluations to employees who were provided and required to use North 7700 Series half face elastomeric respirators. Dana Railcar, A Division of Dana Container, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.134(e)(1), which was contained in OSHA inspection number 1405010, citation number 3, item number 1a and was affirmed as a final order on 8/16/2021, with respect to a workplace located at Coxton Rail Yards, Coxton Road & North Main St, Pittston, PA 18640.
