29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about May 30, 2023, at least one employee was not protected from a pile of backfill (appeared to be small stone/sand, granular in nature) that could pose a hazard by falling or rolling into excavations while accessing a ladder to egress a trench they were working in. The pile of backfill was not at least 2 feet from the edge of the excavation nor was there any retaining devices used to prevent the backfill from falling into the excavation. Woleske Construction Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1586213, citation number 1, item number 1 and was affirmed as a final order on 08/10/2022, with respect to a workplace located at West St & Haskell St, Beaver Dam, WI 53916.
