29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request. The employer fails to ensure that portable fire extinguishers are subjected to an annual maintenance check. a) This most recently occurred on or about November 15, 2022, at an establishment located at 991 Marquette Street in Kewaunee, Wisconsin; Employees are exposed to potential fire hazards while working in the back of the receiving room when the ABC (Dry Chemical) fire extinguisher mounted near the electrical panels is not subjected to an annual maintenance check. The extinguisher tag indicates it has not been inspected since 2020. Dollar General Corporation was previously cited under the name Dolgencorp, LLC dba Dollar General Store 9967 for a REPEAT - OTHER violation of this occupational safety and health standard 1910.157(e)(3), which was contained in OSHA inspection number 1522853, citation number 2, item number 1 and was affirmed as a final order on September 22, 2021, with respect to a workplace located at 1060 E Tuss Street, Eagle River, WI 54521.
