29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. On or about April 10, 2023, the employer failed to certify to OSHA that the following hazards have been abated: 1) Citation 1 Item 1: On or about November 15, 2022, employees engaged in residential construction activities were exposed to fall hazards in excess of 6-feet without using any form of fall protection. 2) Citation 1 Item 2:. On or about November 15, 2022, employees engaged in construction operations were exposed to fall hazards in excess of 6-feet due to in adequacies in fall protection training. 3) Citation 2 Item :1 On or about November 15, 2022, employees performing plastering work were observed working on a scaffold platform that was not fully planked. This condition exposed employees to fall hazards greater than 6 feet from lower levels. Victor Olvera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 1516436, citation number 1 item number 1 and was affirmed as a final order on May 24, 2021, with respect to a workplace located at Solarie Apartments Unit 440 Marbella St. El Paso, TX 79912. 4) Citation 2 Item 2: On or about November 15, 2022, employees performing plastering work were observed working on a scaffold platform that was not supported on base plates or mud sills that were adequate and firm to use as foundation. This condition exposed employees to fall hazards greater than 6 feet from lower levels. Victor Olvera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(c)(2), which was contained in OSHA inspection number 1516436, citation number 1 item number 1 and was affirmed as a final order on May 24, 2021, with respect to a workplace located at Solarie Apartments Unit 440 Marbella St. El Paso, TX 79912. 5) Citation 2 Item 3: On or about November 15, 2022, employees performing plastering work were observed working on a scaffold platform that was not braced as to prevent swaying. This condition exposed employees to fall hazards greater than 6 feet from lower levels. Victor Olvera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(c)(3), which was contained in OSHA inspection number 1516436, citation number 1, item number 2 and was affirmed as a final order on May 24, 2021, with respect to a workplace located at Solarie Apartments Unit 440 Marbella St. El Paso, TX 79912. 6) Citation 2 Item 4: On or about November 15, 2022, the area where materials from the tubular scaffold could fall (struck-by hazard zone) could fall was not barricaded to prevent employees or individuals to walk under the struck-by hazard zone. This condition exposed employees to struck-by hazards. Victor Olvera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(h)(2)(i), which was contained in OSHA inspection number 1516436, citation number 1 item number 3 and was affirmed as a final order on May 24, 2021, with respect to a workplace located at Solarie Apartments Unit 440 Marbella St. El Paso, TX 79912. 7) Citation 2 Item 5: On or about November 15, 2022, employees performing plastering work were observed working on a scaffold platform without toe boards. This condition exposed employees to struck-by hazards. Victor Olvera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.451(h)(2)(ii), which was contained in OSHA inspection number 1516436, citation number 1 item number 1 and was affirmed as a final order on May 24, 2021, with respect to a workplace located at Solarie Apartments Unit 440 Marbella St. El Paso, TX 79912.
