29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. the employer fails to ensure eye protection is used as demonstrated on or about 09/14/2022, at Lot #6 Cyrus Cove Drive, Hoover, AL, where roofers were placing shingles with pneumatic nail guns and not wearing eye protection. To abate this hazard, the employer must ensure eye protection is worn. Rodolfo Marquez was previously cited for a first repeat-serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1444230, citation number 1, item number 1 and was affirmed as a final order 02/05/2020, with respect to a workplace located at 1012 Mountain Laurel Circle, (Lot #79), Moody, AL. Rodolfo Marquez was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1385759, citation number 1, item number 1 and was affirmed as a final order on 07/10/2019, with respect to a workplace located at 7975 Furnace Drive, (Lot #3003), McCalla, AL.
