29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about April 4, 2022, and at times prior, where the employer does not require the proper use of ladders during roofing work. This violation was most recently observed at 4401 Elk Ridge Drive in Bismarck, North Dakota where employees were allowed to continually use a ladder that did not extend three of more feet above the landing surface while installing roofing shingles. To abate this violation, the employer must ensure that its employee's performing roofing work are provided a ladder that extends three or more feet while ascending and descending from a roof. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1554707, Citation 1, Item 1, and was affirmed as a final order on 04-01-2022 with respect to a workplace located at or near 201 Ashlee Avenue in Bismarck, North Dakota.
