29 CFR 1926.651(c)(2):M. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: Entrance to Mass Pike Toll Plaza., Chicopee, MA: On or about November 29, 2021, an employee was observed using half an extension ladder, which is not a safe means of egress per the ladder manufacturer, as his means of egress from this excavation. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1). Morais Concrete Service Inc was previously cited for a violation of this exact standard 29CFR 1926 C (2), which was contained in OSHA inspection number 1539452 citation number 1, item number 1 and was affirmed as a final order on 10/26/2021, with respect to a workplace located across from 182 King St., Northampton, MA.
